Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and ExoF ("ExoF", "we", "us"). They govern your access to and use of the ExoF platform, including account creation, assessments, recommendations, purchases, and any subscriptions.

By creating an account, placing an order, or otherwise using ExoF, you confirm that you have read, understood, and agree to be bound by these Terms and by the privacy practices described in Section 9. If you do not agree, please do not use ExoF.

ExoF is a scientific-intelligence and recommendation platform. It is not a provider of licensed medical care, and it is not the manufacturer of the third-party products it may list.

You must be at least 18 years old and capable of entering into a legally binding contract to use ExoF. By using the platform, you affirm that you are 18 or older.

If you are under 18, you may use ExoF only under the supervision of a parent or legal guardian who acts as the Representative on the account, with full disclosure of that use. We may implement age verification and may suspend accounts we reasonably believe belong to minors using the platform without such supervision.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

ExoF relies on the information you provide. You agree to give true, complete, and accurate information — including any health details and any data from wearables or lab tests you choose to share — and to keep it up to date.

Any health data you provide or connect is used for informational purposes only and is not clinical or diagnostic. If you supply false, incomplete, or outdated information, ExoF assumes no liability for the resulting recommendations or outcomes.

ExoF grants you a limited, revocable, non-transferable, non-exclusive license to use the platform for your personal, non-commercial purposes, subject to these Terms.

You may not:

• scrape, harvest, or collect data from the platform using bots or automation;
• reverse-engineer, decompile, or attempt to extract our models, datasets, or source code;
• hack, probe, or test the security of the platform, or engage in credential stuffing;
• attempt to manipulate, inject prompts into, or otherwise misuse any AI features;
• resell, sublicense, or commercially exploit access to the platform without our written consent.

We may suspend or revoke your license if you misuse the platform.

Not medical advice

ExoF content — including any AI-assisted recommendations — is provided for general informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. ExoF is not a doctor, dietitian, or healthcare provider.

Always seek the advice of a qualified health professional with any questions about your health or your supplements. Never disregard professional medical advice, and do not delay seeking it, because of something you have read on ExoF. ExoF makes no claim to prevent, treat, or cure any condition.

AI outputs may be imperfect

ExoF may use AI and machine learning to process data and generate content. AI output can be incomplete, biased, or inaccurate. To the maximum extent permitted by law, ExoF disclaims all liability for any errors, omissions, or inaccuracies in AI-assisted content, and you agree that any reliance on AI output is at your own risk.

We do not guarantee the accuracy, completeness, or suitability of AI-generated results. You alone are responsible for verifying any recommendation before you act on it.

Supplement recommendations

Any supplement recommendations or comparisons are informational and are not guarantees of effectiveness or safety. ExoF is not responsible for allergic reactions, side effects, or interactions.

We may not hold complete ingredient or cross-contamination information. You are responsible for knowing your own allergies, medical conditions, and medications, and for reading product labels before use. Consult a qualified healthcare professional before starting, stopping, or changing any supplement — particularly if you are pregnant or nursing, have a chronic illness, or are considering use for a child.

Third-party products & sellers

ExoF may list third-party products and content (such as reviews or images). We do not manufacture or endorse these products; they are subject to their manufacturer's or seller's own terms. All product warranties and product issues lie between you and the manufacturer or seller.

To the maximum extent permitted by law, ExoF is not liable for defects, recalls, counterfeits, or mislabeling of third-party products, except where mandatory law provides otherwise.

Subscriptions & auto-renewal

If you enroll in a paid subscription, you authorize ExoF to charge the applicable fees on a recurring basis. Your subscription renews automatically at the stated interval unless you cancel before the renewal date. We will make the billing interval and the amount clear at checkout.

You can cancel at any time from your account settings or by contacting us at support@exof.in; cancellation takes effect at the end of the current billing period. We may change pricing with reasonable prior notice.

Refunds

Except where required by law, fees are non-refundable. If a product is proven defective, adulterated, or mis-sold under applicable law (including under the FSSAI framework or the Consumer Protection Act, 2019), you may seek the remedies those laws provide. We may also honor goodwill refund requests at our discretion.

Repeated refund abuse, including chargebacks for services already used, may result in suspension of your account.

All content on ExoF — including text, logos, interface, data compilations, and software — is owned by ExoF or its licensors and is protected by intellectual-property law. You may not use it beyond your permitted use of the platform.

If you submit content such as reviews or images, you grant ExoF a worldwide, non-exclusive, royalty-free, perpetual license to host, display, moderate, analyze, and use that content in connection with operating and promoting the platform. You retain ownership of what you submit.

You represent that any content you submit is your own or properly licensed and does not infringe anyone's rights, and you agree to indemnify ExoF against claims arising from that content.

Our collection and use of your personal data — including any health data — is carried out in accordance with the Information Technology Act, 2000 and its SPDI Rules, and the Digital Personal Data Protection Act, 2023 as and when its provisions take effect.

We process sensitive personal data only with your consent, for the purposes for which you provide it, and we take reasonable measures to keep it secure. By using ExoF, you consent to receiving communications from us electronically and to the use of electronic records and signatures.

To the maximum extent permitted by law, ExoF and its partners provide the platform and all content "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, ExoF will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of — or inability to use — the platform. Where liability cannot be excluded, ExoF's total aggregate liability will not exceed the total fees you paid to ExoF in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

You agree to indemnify and hold harmless ExoF and its officers, employees, and partners from any claims, damages, liabilities, and reasonable costs (including legal fees) arising out of (a) content you submit, (b) your use of the platform, or (c) your violation of these Terms or of any law. ExoF may assume control of the defense and settlement of any such claim, and you agree to cooperate.

You may stop using ExoF at any time. We may suspend or terminate your access — with or without notice — if you breach these Terms, misuse the platform, or where we are required to by law.

Provisions that by their nature should survive termination — including disclaimers, limitations of liability, indemnification, intellectual-property terms, and dispute resolution — will continue to apply.

These Terms are governed by the laws of India. Subject to the mandatory rights described below, any dispute arising out of or relating to these Terms or the platform will be resolved by binding arbitration seated in [City], India, conducted under the Arbitration and Conciliation Act, 1996, in the English language, before a sole arbitrator.

To the extent permitted by law, you and ExoF agree that disputes will be resolved individually, and you waive any right to participate in a class or representative action.

Nothing in this section limits any non-waivable rights or remedies available to you as a consumer under the Consumer Protection Act, 2019 or other applicable law, including access to the consumer forums.

• Assignment. ExoF may assign these Terms; you may not assign them without our consent.
• Force majeure. Neither party is liable for delays or failures caused by events beyond its reasonable control.
• Compliance with law. You agree to use the platform only for lawful purposes and to comply with applicable export, data-transfer, and other laws.
• Changes to these Terms. We may update these Terms and will give reasonable notice of material changes (for example, to pricing, data use, or liability) by email or an in-product notice. Continued use after changes take effect means you accept them.
• Entire agreement; severability; no waiver. These Terms are the entire agreement between you and ExoF on their subject matter. If any provision is held unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it.
• Notices. We may provide notices to you by email or through the platform.
